1. Acceptance and Binding Effect
1.1 These Terms and Conditions (“Terms”) constitute a legally binding agreement between MedAr and the User.
1.2 Accessing, registering, or participating in any MedAr process shall be deemed unconditional acceptance of these Terms.
2. Nature and Limitation of Services
2.1 MedAr acts solely as a facilitator and administrator of mediation and ADR processes.
2.2 MedAr does not provide legal advice, adjudication, or representation.
2.3 MedAr does not assure or guarantee any outcome, settlement, or resolution.
3. Role, Status, and Protection of Mediators
3.1 Mediators appointed through MedAr act as neutral and independent facilitators.
3.2 Mediators do not represent any party and owe no fiduciary duty to any individual party.
3.3 No mediator shall be impleaded, summoned, examined, or held liable in respect of any act or omission arising out of the mediation process, except in cases of wilful misconduct established in accordance with law.
4. Obligations of Parties
Users undertake to:
(a) participate in good faith;
(b) provide true and complete information;
(c) maintain confidentiality;
(d) refrain from intimidation, coercion, recording, or misuse of proceedings.
5. Confidentiality Obligations
5.1 All proceedings, communications, and materials are confidential.
5.2 Audio or video recording of mediation sessions is strictly prohibited unless expressly authorised in writing by all parties and MedAr.
5.3 Breach of confidentiality shall entitle MedAr to terminate services and pursue remedies available under law.
6. Fees and Payments
6.1 Fees shall be payable as agreed prior to commencement. 6.2 All fees are non-refundable unless expressly agreed in writing.
6.3 MedAr reserves the right to revise its fee structure.
7. Limitation of Liability
To the maximum extent permitted by law, MedAr, its founders, employees, mediators, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages. Aggregate liability, if any, shall be limited to the fees paid for the relevant service.
8. Indemnity
The User agrees to indemnify and hold harmless MedAr, its mediators, employees, and representatives from any claims, losses, liabilities, costs, or expenses arising from breach of these Terms, misuse of services, or violation of law.
9. Termination and Suspension
MedAr reserves the right to suspend or terminate services without notice where conduct undermines legality, neutrality, safety, or ethical standards.
10. Force Majeure
MedAr shall not be liable for failure or delay due to events beyond reasonable control, including acts of God, governmental actions, or technical failures.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Courts at New Delhi shall have exclusive jurisdiction.
12. Amendments
MedAr reserves the right to amend these Terms and the Privacy Policy at any time. Continued use shall constitute acceptance of such amendments.
