This Privacy Policy (“Policy”) is issued by MedAr, a mediation and alternative dispute resolution organisation (“MedAr”, “we”, “our”, “us”), and governs the collection, use, storage, processing, disclosure, and protection of information received from any person accessing or using MedAr’s website, services, facilities, or processes, including clients, disputing parties, mediators, professionals, trainees, and visitors (“Users”).

1. Scope and Applicability
1.1 This Policy applies to all information, whether personal, confidential, sensitive, or case-related, disclosed to or obtained by MedAr during the course of providing mediation, conciliation, facilitation, training, or allied ADR services, whether online or offline.

1.2 By accessing or using MedAr’s services, Users expressly consent to the collection and processing of information in accordance with this Policy.

2. Nature of Information Collected

MedAr may collect, store, and process the following categories of information:

(a) Personal information including name, address, contact details, identification documents, and professional credentials;

(b) Case-related and dispute-specific information, including pleadings, documents, communications, statements, proposals, and settlement terms;

(c) Financial and billing information necessary for fee processing;

(d) Technical and usage data including IP address, device identifiers, browser data, cookies, and logs.

3. Purpose of Collection and Processing

Information is collected and processed strictly for lawful and legitimate purposes, including but not limited to:

(a) Administration, facilitation, and management of mediation and ADR proceedings;

(b) Appointment, empanelment, and coordination of mediators and professionals;

(c) Communication, scheduling, record maintenance, and compliance;

(d) Legal, regulatory, ethical, and contractual obligations;

(e) Internal research, training, and quality control, strictly in anonymised or aggregated form;

(f) Security, risk management, and prevention of misuse.

4. Confidentiality and Mediation Privilege

4.1 All information shared in the course of mediation shall be treated as strictly confidential.

4.2 No information, communication, admission, proposal, or document exchanged during mediation shall be disclosed, relied upon, or produced in any judicial, arbitral, or administrative proceeding, except where disclosure is mandated under applicable law or made with the prior written consent of all parties.

4.3 MedAr shall undertake reasonable measures to preserve confidentiality; however, MedAr does not warrant or guarantee absolute legal privilege where the same is restricted by statute or judicial mandate.

5. Disclosure of Information

5.1 MedAr shall not sell, trade, or commercially exploit User data.

5.2 Disclosure may be made only:

(a) to mediators, professionals, or staff on a strict need-to-know basis;

(b) to third-party service providers bound by contractual confidentiality obligations;

(c) pursuant to legal, regulatory, or court directions;

(d) with express written consent of the concerned User(s).

6. Data Security

MedAr employs reasonable administrative, technical, and organisational safeguards to protect information against unauthorised access, alteration, loss, or misuse. Users acknowledge that no electronic system is entirely secure and agree that MedAr shall not be liable for breaches beyond reasonable control.

7. Data Retention

Information shall be retained only for such period as is necessary to fulfil the purposes stated herein or as required under applicable law. Upon completion of proceedings, records may be archived, anonymised, or securely destroyed at MedAr’s discretion.

8. User Rights

Subject to applicable law, Users may request access, correction, or deletion of personal data. MedAr reserves the right to refuse such requests where retention is required for legal, regulatory, or legitimate business purposes.

9. Third-Party Platforms

MedAr shall not be responsible for the privacy practices or content of any third-party websites or platforms linked to its website.

10. Governing Law

This Policy shall be governed by and construed in accordance with the laws of India.
